William Ben Darby was a Huntsville police officer involved in an on-duty shooting in 2018. Officer Ben Darby was cleared by his department after an Incident Review Board determined he was justified, and followed all applicable policies and laws as established by the United States Supreme Court.
The District Attorney used Ben as a political football and wrongfully charged him with murder. A wrongful conviction resulted in Ben being sentenced to 25 years in prison.
Evidence was withheld that any reasonable jury would have used to exonerate Ben. The District Attorney engaged in the highest levels of prosecutorial misconduct and continues to tell falsehoods to the public regarding this incident.
But Ben persevered, fought on appeal, and after 20 months in prison he won his freedom. The wrongful murder conviction was unanimously overturned by the Alabama Court of Criminal Appeals and Ben was freed.
But even now, the same prosecutor wants to take Ben back to trial in December 2023.
Examine the facts. Support an honorable man in this war on police.
Ben is a husband, son, and has lived a life of service and honor. Ben is a man of faith and continues to endure this trial. His love for his family and country, as well as his involvement in church and community is revered by all who know him. He served as a police officer, risked his life for others, and now needs help as he fights for his own life.
